Curtis Eakman who is 52 years old who owns Penn Hills Monuments originally with his then wife debra when they bought the placew in 2009 and then after a 2012 divorce he became the sole owner. This is a buskiness that does scustomized tombstones for graves for which he has charged with stealing from 51 people.. He was charged with theft by deception and business fraud both of which are considered felonies He is charged with collecting the money for the tombstones but never actually got the tombstones for the people. He ordered slabs of granite from conpanies but never paid them for it and was tens of thousands of dollars worth of debt to the granite companies. Yet he continued to take orders that cost a lot of money from people without planning on giving them their tombstones. He asked for the money then spent the money on meals at restauarants and jewelry. IT is said he used the money as ":his personal piggybank"
Detective Jackelyn Wabel from the Distrct Atorney's office wrote in the complaint that Eakman "Continued to accept money from the victim customers , even though he knww he could not honor their sales agreement.
Eakman showed up at the courtroom for a civil trial and Penn Hills Police Department and Allegheny County District Attorney's office were there and arrested him. When arrested Eakman It"s not true . The tombstones are finished." But the problem is the police according to Eakman who says the police "illegally locked him out" of the business when the police did a search warrant of his business in January 2014.
Alleged victims could not believe Eakman would do this to them when they are in te grieviing process.
Gus Anderson whose son Kristopher died in late 2012 said, "it's hard to believe that somebody could do something like thia, it's frustating . I went to talk to him and he said something about he hadn't heard back fro, the granite company , which seemed a=odd. I mean what kind of person do you have to be to do something like this?I just don't understand it at all".

In his opinion President Judge McBride wqrote a "a fair trial, of course is not a perfect trial Errors can and do occur. He admitted the prosecution made an errorThen wrote on that "To be certain The Commonwealths preparation for trial was not adequyate and therefore did not constiutiute error. The commonwealth came forth as soon as it became known the detective was mistaken as to whether he took the photographs or not. McBride wrote "The Judicial error was avoidable had the court not allowed the exhibits to be admitted until Detective Chamberlain could ascertain when the photographs were taken .:
McBride did not address an allegation that the defense was saying that if ir couldn't get a plea bargain then the defense that they woukld seek a mistrail.
